When is a building permit required?
Building permits are required for any new construction of a building and/or the modification of an existing structure that involves a change in the building structural components or building mechanical systems such as electrical, plumbing, heating or ventilation systems. Permits are also required for new, or modifications of septic systems including holding tanks. These requirements are imposed by the State of New York and the town is required to enforce those requirements.
It is the policy of the Town of Galway that certain work, such as the installation of new siding, windows or door replacement, roofing repair and other similar property maintenance items do not require a building permit as long as no structural component of a building is altered or modified. To avoid any confusion, you are encouraged to contact the Building Inspector to discuss your project and obtain proper guidance relative to the requirement for a building permit.
Remember - you are responsible for knowing if a building permit is required. Failure to obtain a building permit when it is required may result in your project being stopped or being cited with an appearance ticket to town Justice Court. When in doubt call the Building Inspector's office for clarifications.
How long is a building permit good for?
A building permt is valid for one (1) year after the date of issue. If your project is taking longer than one year please contact the office to have the permit renewed or extended.
When do I get my Certificate of Occupancy (CO)?
When your project is complete you will receive a final inspection to verify all aspects of your project have complied with appropriate codes and regulations. Once the final inspection has been satisfactorially completed you will receive your Certificate of Occupany or Certificate of Completion on any accessory structures. Your bank or lending institution will often require a copy of the CO to verify a satisfactory end to the construction phase of your project.
When do I have to get my septic system inspected?
The Town of Galway Zoning Regulations do require an inspection of the "on-site waste treatment system (OWTS)" or septic system whenever a property in the Lake District is sold or otherwise transferred to a new owner. This inspection must be done by a professional engineer (PE), certified by the State of New York with ability to provide a certified PE stamp, who will certify the system is working as designed and is fully usable.
